1. Agreement to terms
By engaging Two by Two Company LLC ("Company") for marketing services, you agree to these Terms of Service. If you do not agree, do not use our services.
2. Services
Two by Two Company LLC provides marketing automation services including but not limited to: SMS automation, reputation management, website development, Google Business Profile management, and client retention campaigns. Services are provided on a month-to-month basis unless otherwise agreed in writing.
3. SMS communications
Our SMS services are delivered in compliance with the Telephone Consumer Protection Act (TCPA) and A2P 10DLC carrier requirements. Our clients are responsible for ensuring they have proper consent from their customers to receive SMS messages. We do not send unsolicited messages. All messages include opt-out instructions (reply STOP to unsubscribe).
Message and data rates may apply to SMS recipients. Message frequency varies based on the services configured. By receiving messages sent through our platform, recipients acknowledge that consent is not required as a condition of any purchase.
4. Client responsibilities
Clients who engage our services agree to:
Provide accurate business information for setup and compliance
Ensure they have proper consent from their customers before we send communications on their behalf
Not use our services for spam, fraud, or any unlawful purpose
Promptly notify us of any opt-out requests received outside our system
Comply with all applicable laws and regulations
5. Payment terms
Services are billed monthly in advance. Setup fees are non-refundable. Monthly fees may be cancelled with 30 days written notice. Late payments may result in service suspension.
6. Intellectual property
We retain ownership of our systems, templates, workflows, and proprietary tools. Clients retain ownership of their business data and content. Upon termination, we will provide clients with an export of their contact data.
7. Limitation of liability
Two by Two Company LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability shall not exceed the fees paid in the three months preceding the claim.
8. Termination
Either party may terminate services with 30 days written notice. We reserve the right to immediately terminate services for violation of these terms, non-payment, or unlawful use.
9. Governing law
These Terms are governed by the laws of the State of Arizona. Any disputes shall be resolved in Maricopa County, Arizona.
